Right of withdrawal
After the receipt of the order, the buyer is entitled to withdraw from the contract concluded at the online shop within 14 days.
The buyer does not have the right of withdrawal for perishable, aging, open hygiene products and underwear.
The right of withdrawal does not apply if the buyer is a legal person.
To use the 14-day right of withdrawal, the ordered goods may not be used otherwise than for the purpose of verifying the nature, characteristics, and functioning of the goods, as is permitted for testing the goods in a physical store. The goods must be in the original packaging, with the attached labels and manufacturer’s markings.
If the goods have been used for any other purpose than is necessary for verifying the nature, characteristics, or functioning of the goods, or the goods have signs of use or wear, the online shop shall be entitled to reduce the amount of refund pursuant to the impairment of the goods.
To return the goods, the buyer shall submit an application of withdrawal from the purchase of goods, the sample form of which is available here, and send it to the e-mail address firstname.lastname@example.org at the latest within 14 days as of the receipt of the goods.
The costs of returning the goods shall be borne by the buyer, unless the reason of returning is the fact that the item subject to return does not conform to what was ordered (e.g. incorrect or defective item).
The buyer shall return the goods no later than within 14 days as of the submission of the application or shall present proof that the buyer has handed the goods over to the carrier within the said period.
Upon receipt of the returned goods, the online shop shall return to the buyer immediately, however no later than within 14 days as of the receipt of the application of withdrawal, all the fees received from the buyer under the contract.
The online shop may refuse to make a refund until it has recovered the item serving as object of the contract or until the buyer presents proof that they have sent back the item, whichever is earliest.
If the buyer has explicitly chosen a different method for receiving the goods than the regular cheapest way suggested by the online shop, the online shop will not be obliged to refund to the consumer the costs that exceed the expenditures related to the regular method of delivery.
The online shop has the right to withdraw from the sales contract and reclaim from the buyer the goods if the price of the goods at the online shop is marked significantly below the market value of the goods due to an error.
Right to file a complaint
The online shop is responsible for the non-compliance of the goods sold to the buyer with the terms and conditions of the contract or for defects that existed already at the time of delivery of the item and which occur within up to two years as of handing the goods over to the buyer. During the first six months as of delivering the item to the buyer, it is presumed that the defect existed already at the time of handing the item over. Rebuttal of the presumption is the obligation of the online shop.
Upon the occurrence of a defect, the buyer has the right to contact the online shop within two months at the latest by sending a letter at email@example.com.
The online shop is not responsible for the defects caused to the goods after delivery of these to the buyer.
If the goods purchased from the online shop have defects for which the online shop is responsible, the online shop shall repair or replace the defective goods. If the goods cannot be repaired or replaced, the online shop shall return to the buyer all fees pertaining to the sales contract.
The online shop shall respond to the consumer’s complaint in writing or in a format which can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The online shop uses the personal data entered by the buyer (incl. name, phone number, address, e-mail address, requisite bank information) only for processing the order and sending the goods to the buyer.
The online shop transfers the personal data to companies providing the transportation service to deliver the goods.
The online shop sends the buyer newsletters and offers at the e-mail address of the buyer only if the buyer has expressed the wish to receive them by entering the e-mail address to the website and has stated its request to receive direct marketing communications. The buyer may withdraw from the offers and newsletters sent to the e-mail at any time by informing us thereof by e-mail or following the instructions given in the e-mail containing the offers.
If the buyer has complaints regarding the online shop, these shall be communicated by e-mail at firstname.lastname@example.org or by phone on +372 51999135.
If the buyer and the online shop are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee.
The procedural conditions can be examined and a petition filed on the webpage www.komisjon.ee. The Consumer Disputes Committee is competent to resolve the disputes arising from the contract concluded between the buyer and the online shop. The review of the buyer’s dispute in the committee is free of charge.
